These Terms & Conditions ("Terms") govern your use of fwreshbarbershop.com, our booking system, AI receptionist, and SMS communications operated by Fwresh Salon & Barbershop ("Fwresh," "we," "us," "our"). By booking an appointment, calling our number, or texting us, you agree to these Terms.
1. Appointment Booking
- You may book through our website, by phone, with our AI receptionist, or in person.
- You must provide accurate name, phone number, and email so we can confirm and contact you about your appointment.
- Time slots are reserved on a first-confirmed basis. A slot is not held until you receive confirmation.
- You must be 18 or older to book on your own behalf. Bookings for minors must be made by a parent or legal guardian.
2. Cancellations & Rescheduling
- Please cancel or reschedule at least 24 hours before your appointment.
- Late cancellations or no-shows may be subject to a fee charged to the payment method on file.
- You can cancel or reschedule by replying to your confirmation text, calling the shop, or using your account on our website.
3. Deposits, Travel Fees & Payment
- Some services and all mobile bookings may require a deposit or travel fee at the time of booking.
- Payments are processed securely by our payment provider. We do not store full card numbers.
- Refunds for deposits follow the cancellation policy above.
4. SMS Messaging Program
By providing your mobile phone number to Fwresh — through our website, AI receptionist, or in person — you expressly consent to receive transactional text messages from Fwresh Salon & Barbershop. This SMS program is operated by Fwresh and delivered via Twilio.
- Program description — appointment confirmations, reminders, schedule changes, account verification codes, and customer support replies.
- Message frequency — message frequency varies based on your bookings and activity.
- Carrier charges — message and data rates may apply. Fwresh is not responsible for charges from your wireless carrier.
- Supported carriers — major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.
- Help — reply HELP to any text for assistance, or contact us at 617-288-2220.
- Cancel — reply STOP to any text to unsubscribe. You will receive a final confirmation message and no further texts. To resume, reply START or opt in again.
- No sharing — we do not sell, rent, or share mobile information or SMS opt-in data with third parties for marketing.
5. AI Receptionist
Calls to our published phone line may be answered by an automated AI receptionist that can check availability, book appointments, and answer common questions.
- By continuing the call, you consent to interact with an automated system and to the recording and transcription of the call for booking, quality, and dispute resolution.
- The AI may collect your name, phone number, and requested service to create or update an appointment.
- You may ask to be transferred to a human team member at any time.
- The AI is provided as a convenience. Final appointment confirmation is sent by SMS or email.
6. Accounts
If you create an account, you are responsible for safeguarding your credentials and for any activity under your account. Notify us immediately of any unauthorized use.
7. Acceptable Use
You agree not to:
- Use the site, AI receptionist, or SMS program for unlawful, abusive, or harassing purposes.
- Attempt to interfere with, reverse engineer, scrape, or overload our systems.
- Submit false information or impersonate another person.
- Use the service to send spam or unsolicited communications.
8. Service Availability
We work hard to keep our website, booking system, AI receptionist, and SMS notifications available, but we do not guarantee uninterrupted service. Maintenance, carrier delays, third-party outages, or other factors may temporarily affect availability.
9. Disclaimer of Warranties
The website and related services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, to the maximum extent permitted by law.
10. Limitation of Liability
To the fullest extent permitted by law, Fwresh and its team members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the website, AI receptionist, SMS program, or our services. Our total liability for any claim is limited to the amount you paid us in the 30 days before the claim arose.
11. Indemnification
You agree to defend and indemnify Fwresh from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of our services.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date reflects the latest revision. Continued use of our services after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Suffolk County, Massachusetts.
